1. Acceptance of Terms
By accessing and using Scrappy ("the Platform"), you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, you must not use our services.
2. Description of Service
Scrappy provides aggregated market intelligence, store location data, and business density metrics collected from publicly available domains and third-party APIs. We organize this data into interactive dashboards, maps, and downloadable CSV exports for business and research use.
- No Affiliation: Scrappy is NOT affiliated with, endorsed by, or connected to any of the brands listed on our platform.
- Public Data: All data is sourced from public domains. We do not generate original business data.
3. User Accounts
To access our features, you are required to create an account. You are responsible for maintaining the confidentiality of your login credentials. Scrappy reserves the right to suspend or terminate accounts that violate our terms or compromise platform security.
4. Purchases, Subscriptions, and Payments
- Subscription Tiers: We offer a restricted "Free" tier and a paid "Pro" subscription.
- No Free Trials: We do not offer free trials for our Pro subscription. Users are encouraged to fully evaluate the platform's features, visual dashboards, and basic data quality using our perpetual Free Tier before making any financial commitment.
- Recurring Billing: Pro subscriptions are billed on a recurring monthly basis. By subscribing, you authorize us to charge your provided payment method automatically at the start of each billing cycle.
- One-Time Dataset Purchases: Data exported via our Custom Export Builder or Data Store is billed dynamically based on data volume and your current tier. By completing a checkout, you agree to the calculated price.
- Payment Processing: All payments are securely processed via Stripe. We do not store your credit card information.
5. Refund Policy (Digital Goods)
- CSVs & Exports: Due to the digital and instantly accessible nature of our dataset exports (CSVs), all one-time data purchases are final and non-refundable.
- Subscriptions: You may cancel your Pro subscription at any time. Cancellation takes effect at the end of your current paid billing cycle. We do not provide prorated refunds for partially used billing periods.
6. Permitted Use of the Platform
You are granted a non-exclusive, non-transferable license to use the platform, dashboards, and exported data for:
- Internal business analysis and research.
- Academic or market research.
- Informational purposes.
7. Prohibited Uses
You strictly agree NOT to:
- Resell or Redistribute: Sell, rent, lease, or publicly distribute the CSV data exports or platform access to third parties.
- Share Access: Share your account login credentials with others.
- Scraping: Use automated bots, spiders, or scrapers to extract data or bypass limits on the Scrappy platform.
- Reverse Engineering: Attempt to reverse engineer, decompile, or disassemble any part of the platform.
8. Intellectual Property
The Scrappy platform, including its design, code, dashboard structure, and analytical models, is the intellectual property of Scrappy. The raw factual data belongs to its respective public owners, but the compilation, visual benchmarking, and formatting provided by Scrappy are protected by copyright.
9. Data Accuracy Disclaimer & Real-World Latency
The data provided on our platform is aggregated from public domains and third-party APIs. While we strive for high coverage, Scrappy does not guarantee that any brand's data is 100% accurate, complete, or up-to-date.
You explicitly acknowledge and agree that real-world business directory data is subject to constant change. Discrepancies may occur due to:
- Store Openings & Closures: Newly opened branches, recently permanently closed outlets, or temporary franchise shutdowns may not be reflected immediately on official brand websites, third-party maps, or our database.
- Shopping Mall & Complex Coordinates (Centroid Fallback): For outlets located within shopping malls, commercial complexes, transit hubs, or office towers (e.g., IOI City Mall, Mid Valley Megamall), the coordinates (latitude and longitude) provided may resolve to the center point (centroid) or main entrance of the entire development, rather than the exact physical retail unit inside.
- Relocations & Renovations: Outlets shifting units within a mall or temporarily closing for remodeling.
- Data Sync Latency: Third-party mapping providers, geocoding engines, or public source directories may have update delays that are beyond our control.
All data is provided on an 'as is' and 'as available' basis. Scrappy disclaims any and all warranties, express or implied, regarding the commercial usefulness or precise accuracy of the datasets.
10. Limitation of Liability
To the fullest extent permitted by law, Scrappy shall not be liable for any:
- Business or financial losses (loss of profits, revenue, or data).
- Decisions made based on the provided data or dashboards.
- Inaccuracies originating from third-party data sources.
11. Indemnification
You agree to defend, indemnify, and hold harmless Scrappy and its operators from any claims, damages, obligations, losses, or liabilities arising from your use of the platform, your violation of these Terms, or your misuse of the exported data.
12. Account Termination
We reserve the right to modify, suspend, or terminate your access to the service at any time, for any reason, without notice, particularly if you are found to be in violation of these prohibitions (e.g., scraping, sharing accounts, or reselling data).
13. Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of Malaysia. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts in Malaysia.
